These General Terms and Conditions of Sale (CGV) apply to all sales of subscription services for Adsmithy, operated by Merlio (SIREN 884589896, Paris, France), on its website.
Services
Adsmithy is an AI-powered ad creation platform that enables businesses and marketers to generate professional advertising creatives. The platform provides tools for creating product ads, adapting visuals across multiple advertising platforms, and generating compelling ad copy using advanced AI technologies. While the service offers free access to basic features, users can purchase subscription plans to unlock enhanced functionalities and advanced AI capabilities.
Prices
The prices of the subscription plans are indicated on the website in Dollars ($) and include all taxes. Merlio reserves the right to modify its prices at any time, but the applicable price will be the one in effect at the time of the order.
Order and Payment
To place an order, the user must create an account, select the desired subscription plan, and proceed to payment. Payment can be made through Stripe's secure payment platform, which supports various payment methods including:

Execution of the Service
The subscription services are activated immediately after the payment has been accepted. The user can then access the enhanced features according to the conditions described on the website.
Right of Withdrawal
Our services consist of providing digital content and subscription services, which are not supplied on a tangible medium. In accordance with EU consumer law, you lose your right of withdrawal once the digital service has begun with your prior express consent.
By accepting these terms and conditions and proceeding with the purchase, you expressly agree to the immediate execution of the service and confirm that you waive your 14-day withdrawal right.
No refunds will be issued once your subscription is activated and credits are delivered, including (but not limited to) cases where any credits have been used or AI tools accessed (text, image, audio, etc.).
If no credits have been used and no premium features accessed, you may request a refund within 14 days by contacting us via our Contact page. By purchasing and using Adsmithy, you agree to this policy.
Subscription Renewal and Cancellation
Subscriptions are automatically renewed at the end of each billing period (monthly or annual) unless cancelled before the renewal date. You may cancel your subscription at any time from your account settings or by contacting us at hello@adsmithy.com.
Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date. No partial refunds are issued for unused time within a billing period.
Intellectual Property
All content on this website, including but not limited to text, images, graphics, and logos, is the exclusive property of Merlio or its licensors and is protected by intellectual property laws. Any unauthorized use, reproduction, or distribution of this content is strictly prohibited.
Limitation of Liability
Merlio strives to provide accurate and up-to-date information on this website. However, we make no warranties or representations, express or implied, regarding the accuracy, completeness, or reliability of the information provided. We shall not be held liable for any damages resulting from the use or interpretation of the information on this website.
Applicable Law and Jurisdiction
These CGV and the use of this website are governed by the laws of France. Any disputes arising from or related to these CGV or the use of this website shall be subject to the exclusive jurisdiction of the courts of France.
Complaints and Mediation
For any complaint regarding our services, please contact us first at hello@adsmithy.com. We will endeavour to respond within 30 days.
In accordance with Articles L.611-1 and R.612-1 of the French Consumer Code, if your complaint is not resolved to your satisfaction, you have the right to refer the matter free of charge to a consumer mediator.
